Terms of Service

The service

Ascend is a steps-first fitness app that shows your steps, trends, and workouts using data from Apple Health, and lets you record walks and runs. The app is provided for your personal, non-commercial use.

Your account

You need an account (email and password) to use the app. You're responsible for keeping your login secure and for activity under your account. Provide accurate information and keep it up to date. You must be at least 13 years old (or the minimum age required in your country) to use the app.

Health information & no medical advice

You access Apple Health data through Apple's HealthKit, and your use of that data is also subject to Apple's terms. You grant Ascend permission to read the Health data you choose to share and to write workouts you record back to Apple Health.

Ascend Pro subscription

Some features (such as monthly trends) require Ascend Pro, an auto-renewing subscription sold through the Apple App Store.

• Ascend Pro is $2.99 per month and may include a 3-day free trial for new subscribers. Pricing may vary by region and is shown in the app before you purchase.
• Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Manage or cancel anytime in your Apple ID Settings → Subscriptions. Purchases, renewals, and refunds are handled by Apple under the Apple Media Services Terms.

Prices may change in the future; if they do, existing subscribers are handled according to Apple's rules for price changes, and any increase will not apply to your current billing period without notice.

Acceptable use

You agree not to:

• reverse engineer, decompile, or attempt to extract the source code of the app, except as allowed by law;
• interfere with or disrupt the app, its servers, or its security;
• access the app using automated means, or attempt to gain unauthorized access to any account or data;
• use the app to break any law or infringe anyone's rights.

Intellectual property

The app — including its design, branding, and the content we provide — is owned by Ascend and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal purposes under these terms. Your own data (your workouts and health information) remains yours.

Termination

You can stop using the app and delete your account at any time from within the app. We may suspend or terminate your access if you violate these terms or misuse the app. Sections that by their nature should survive termination (such as disclaimers and limitations of liability) will continue to apply.

Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that any data or estimate it shows will be accurate.

Limitation of liability

To the fullest extent permitted by law, Ascend will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

Apple

These terms are between you and Ascend, not Apple. Apple is not responsible for the app or its content and has no obligation to provide support or maintenance for it. Apple is a third-party beneficiary of these terms and may enforce them against you.

Governing law & changes

These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules, except where local consumer-protection law grants you stronger rights. We may update these terms from time to time; we'll change the date above, and continued use of the app after changes means you accept the updated terms.
